Lost earnings (if you have lost income, such as wages, due to the criminal offense)

You can apply for compensation for lost earnings if, due to the criminal offense, you have experienced a reduction in your wages/income. Your lost earnings are the difference between the wages/income you could have expected to receive if you had not been a victim of the criminal offense and the wages/income you actually received.

Example: You are a victim of assault and as a result, you are forced to take sick leave. You do not have the right to paid sick leave at your job, but you meet the conditions to receive sick pay from the municipality.

Your compensation for lost earnings would therefore be the difference between the wages you would normally have received (expected income) and the sick pay (actual income).

The rule is found in section 2 of the Liability and Compensation Act.
