Compensation for loss of breadwinner for spouse/partner

Compensation for loss of breadwinner is intended to financially compensate you for the fact that your spouse or partner can no longer contribute to the joint support.

Compensation for loss of breadwinner for a spouse or partner amounts to 30% of the compensation that the deceased would have received in the case of a total loss of earning capacity. However, the compensation currently amounts to a minimum of 1,031,000 DKK (2020 level).

The minimum compensation can be reduced if special circumstances exist. For example, this could apply where the deceased did not provide any support or only provided minimal support.

If the deceased was over 30 years old at the time of death, the compensation will be reduced according to the rules in section 9 of the Liability for Damages Act. This means that the compensation is reduced by 1% for each year the deceased was older than 29 years at the time of the injury. If the deceased was 55 years old, the compensation is further reduced by 2% for each year they were older than 54 years at the time of the injury. The compensation is not further reduced once the deceased has reached the age of 69.
