Compensation for surviving relatives

If a person has caused the death of another intentionally or through gross negligence, you may be eligible to apply for compensation as a surviving relative, provided you were particularly close to the deceased.

Those who were particularly close to the deceased typically include the spouse, cohabitant, minor children, or parents of minor children.

It is the board that assesses:

  • Whether compensation should be paid
  • The amount of compensation

In its assessment, the board places particular emphasis on the nature of the criminal offense and the suffering or violation that is assumed to have been caused to the surviving relatives.

The rule is found in section 26a of the Liability and Compensation Act.
