Legal expenses insurance may be attached to home insurance (contents insurance), car insurance, house insurance, and boat insurance. Further information about legal expenses insurance can be obtained by contacting the insurance company, and it is the insurance company that decides whether the insurance covers the specific case.
If the insurance company has declined to cover the case, for example because the company believes that the applicant does not have reasonable grounds to pursue the case under the terms of the insurance, an application for legal aid can be made in the usual way.
The Department of Civil Affairs may grant an exemption from the requirement that the applicant is not covered by legal expenses insurance if it is clear that the costs of the case cannot be kept within the insurance's coverage limit, and the nature of the case or other circumstances justify this exceeding. In such cases, the Department of Civil Affairs will conduct the usual assessment of the other conditions for granting legal aid, including whether the applicant has reasonable grounds to pursue the case.
It is also possible to apply for compensation for the portion of legal costs that could not be covered within the maximum coverage of a legal expenses insurance, cf. Section 336 of the Danish Administration of Justice Act. An application for compensation under Section 336 is processed by the Department of Civil Affairs. The compensation in section 336 is only relevant if the court case is cinlcuded ans was covered by insurance.
