According to Section 329 of the Danish Administration of Justice Act, the Department of Civil Affairs, may grant legal aid, even if the usual conditions for legal aid under Section 325 of the Administration of Justice Act, cf. Sections 327 and 328, are not met, when special reasons justify it.

The provision in Section 329 allows for legal aid to be granted even if the usual conditions are not met.

This specifically applies to cases that are of a principle nature, of general public interest, or that have significant implications for the applicant’s social or professional situation.

It is stated in the preparatory works for the provision that cases of a principled nature or of general public interest refer particularly to cases that raise previously unresolved questions of legal interpretation, cases involving more significant interventions against individuals or groups, and cases where the decision could serve as a precedent for future cases.

Cases that have significant implications for the applicant’s social or professional situation may, in some circumstances, include cases arising from small-scale self-employment.

An application for legal aid under Section 329 of the Danish Administration of Justice Act is submitted to the Department of Civil Affairs.
