Legal aid abroad

An application for legal aid for a court case abroad is decided according to the laws of the respective country.

Denmark has acceded to the Strasbourg Convention concerning the transmission of applications for legal aid and legal assistance between various countries. The rules of the convention are outlined in Executive Order no. 109 of 11/11/1986, which implements the European Convention of 27/1/1977 on the transmission of applications for legal assistance.

The Department of Civil Affairs acts as the central authority and forwards applications for legal aid in cases to other countries that have acceded to the Strasbourg Convention. Likewise, the Ministry of Justice, Department of Civil Affairs receives applications from other countries' central authorities and processes them according to the rules for legal aid under the Administration of Justice Act or ensures that the application is forwarded if it needs to be handled by the court.

As a rule, the application must be written in the official language of the respective country or in English or French. The Department of Civil Affairs neither translates nor pays for the translation of the application.

In addition to Denmark, the following countries have ratified or acceded to the convention: Azerbaijan, Belgium, Bosnia and Herzegovina, Bulgaria, Cyprus, Estonia, Finland, France, Georgia, Greece, Ireland, Italy, Latvia, Lithuania, Luxembourg, North Macedonia, Montenegro, the Netherlands, Norway, Poland, Portugal, Romania, Switzerland, Serbia, Spain, the United Kingdom of Great Britain and Northern Ireland, Sweden, the Czech Republic, Turkey, Ukraine, and Austria.
